LESSON 1: Tweet in haste, repent at leisure

Who would have thought that an elderly Tory peer would become a leading innovator in internet law? Yet that is what Lord McAlpine has become. It's not clear whether it was him or his lawyers who came up with the idea of going after the UK Twitter users who tweeted ? or retweeted ? false allegations that he had been involved in child abuse, but, whoever was responsible, the fact is that it has changed the legal landscape in the UK.

The smart move was to discriminate between different classes of users. Those with 500 or fewer followers could get in touch with McAlpine's lawyers and, upon payment of a small fee to charity, escape with a pardon. More substantial tweeters were required to pay heftier damages or face the full force of m'learned friends in court.

Chief among the latter was Sally Bercow, Mr Speaker's lively spouse, who, at least at the time of writing, seems determined to see things through to the bitter end. If it comes to that, we can look forward to an entertaining and instructive legal contest.

All of which is comforting for the establishment. At last, the unruly internet beast is being tamed. Twitter gives broadcast-type communication power to ordinary citizens and if a broadcasting network such as the BBC can be held responsible for what it transmits, surely Twitterers should be too?

Only up to a point, Lord Copper. Obviously, people should be responsible for their actions, but it's absurd to judge the behaviour of a thoughtless individual by the same standards as we apply to that of a professional news organisation such as the BBC. If the only tweets that were judged acceptable were anodyne ones, then the value of Twitter as a public service would be greatly diminished. Besides, lots of professional journalists made similar errors in jumping to conclusions about the identity of the Sandy Hook killer.

LESSON 2: Valuing technology companies remains an inexact science

Before Facebook's initial public offering (IPO), the big question was: how much is the company worth? Post-IPO, the answer was: less than we thought ? or were led to believe by Wall Street. Facebook shares fell 24% in the first three days of open trading, a fact that has led some disgruntled investors to contemplate legal action. Clearly they hadn't heard that valuations of internet companies arrived at by consulting the entrails of chickens are possibly as reliable as those arrived at by legions of spreadsheet-wielding consultants.

But the story of Facebook's oscillating valuations paled into insignificance compared with the row about the price that Hewlett-Packard, the troubled US computer giant, paid for software firm Autonomy. In October 2011, HP bought the Cambridge-based company for $11.7bn. Last month, HP announced that it was taking an $8.8bn write-off because it had realised that Autonomy was not worth anything like its purchase price. HP claimed that $5.5bn of the write-off was explained by the discovery of "accounting irregularities".

HP's criticisms are vigorously denied by Mike Lynch, the founder of Autonomy, who has set up a website to contest them. Meanwhile, in another part of the forest, Larry Ellison, the CEO of Oracle, has also set up a website, which claims that "Autonomy had been 'shopped' [ie offered for sale] to Oracle as well, but Oracle wasn't interested because the price was way too high". While all of this is going on, the average reader might be forgiven for asking how a big company such as HP could have made an $8.8bn mistake in its valuation of a prospective acquisition. Shouldn't it have taken the advice of accountants?

It turns out that it did. The New York Times reported that all of the Big Four firms ? KPMG, Ernst and Young, Deloitte and PwC ? had been consulted at one time or another. Next time, HP should try those chicken entrails.

LESSON 3: Raspberries come in unexpected flavours

A few years ago, Eben Upton and some of his academic colleagues in Cambridge University's Computer Laboratory became concerned about the fact that most of the kids who wanted to study computer science no longer knew how to program. So they had the idea of designing a small, cheap computer that they could give to prospective students at open days. Anyone who turned up for interview would be asked what they'd done with it and only those who had done something interesting would be considered for admission.

Thus began the most intriguing home computing experiment since the BBC Model B transformed Britain's IT landscape in the 1980s. "We thought we'd make maybe a few hundred of these devices," Upton wrote later, "or, best case, a lifetime production run of a few thousand."

How wrong can you be? When Raspberry Pi, for that is what the device was eventually christened, was announced, 100,000 people joined the mailing list. When it went on sale, the demand crashed the servers of the two major online retailers that had signed up to sell it. To date, it has sold more than 800,000 units and stands as an astonishing rebuke to the sceptics who said that in these days of iDevices and tablets there was no market for a device that ran Linux and simply sat blinking at you when you switched it on. But then that's what they also said about the BBC Micro.

LESSON 4: The iPad isn't a magic bullet for publishers after all

Print publishers hate the web, partly because they can't control what people do with the content that they publish on it, but mainly because they can't make the buggers pay for it. So when the Apple iPad arrived they fell upon it like ravening wolves. Sure, they had to pay the Apple 30% tax for publishing through the iTunes store, but at least the customer paid something. And the gorgeous screen and processing power of the Apple tablet meant that publishers could create "immersive reading experiences" that, coincidentally, kept the reader from venturing out into the nasty world wild web.

Ever willing to try something new, Rupert Murdoch launched The Daily, the world's first iPad-native newspaper, in February 2011. He closed it on 15 December 2012, saying that the product "could not find a large enough audience quickly enough to convince us the business model was sustainable in the long term".

An expensive mistake? Yes, but also a valuable experiment for the rest of us. The truth is that iPad publications may look cool, but they can be pretty clunky. For one thing, you have to download the whole publication before you can start reading page one. (Imagine if you had to do that with websites.) For another, they are mostly "little more than heavy PDF files, weighed down with multimedia bells and whistles". That's not to say that iPad-native magazines don't have a place in the digital ecosystem, but they're not the magic bullet the publishing industry once hoped they would be.

LESSON 5: Why Facebook should not have a seat at the United Nations

With a billion users, Facebook may have as many people as India, but basically it's a dictatorship. Come to think of it, adhering to democratic principles is not ? and never has been ? a requirement for admission to the UN club. Robert Mugabe's Zimbabwe, is a member, for example, as are Iran, Belarus and Angola. So maybe Facebook's CEO would feel quite at home at the UN's New York HQ. After all, like all the best dictators, he always knows what is best for his people.

He knows, for example, that they want everything to be "social" ? ie open to the world. He also knows that their petty obsessions with their privacy are just that ? petty. Only the other day, the company announced the termination of users' ability to hide from Facebook searches. Sam Lessin, one of Zuck's henchmen who has the interesting title of "director of product", told journalists that the ability to hide from the site's search would be "retired" as only "a single-digit percentage of users" actually hide themselves from Facebook search. How George Orwell would have loved that use of the word "retired"!

Given that Facebook has a billion users, a single-digit percentage could mean tens of millions of privacy "retirees". Oh and by the way, the "product" in Mr Lessin's job title is you and me.

LESSON 6: Book publishers have finally realised that they are the main course in Amazon's lunch menu

Here's a riddle: "Disintermediation is a very long word. How do you spell it?" The answer, of course, is "it". But disintermediation is now the mot de jour. It means wiping out the intermediary and that is what the internet does. Remember travel agents? Record shops? Bookshops? Book publishers?

For a long time, publishers maintained that, while the internet was certainly destroying the business models of other industries, book publishing was such a special business that it wouldn't happen to them. After all, in the end, every author needs a publisher ? doesn't s/he? Only sad people go in for self-publication.

Er, not necessarily. The arrival and widespread acceptance of ebooks, together with on-demand printing and Amazon's ebook publishing engine have transformed self-publishing from a dream to a reality. If you've written something and it's in Microsoft Word format, then upload it to Amazon's publishing engine, upload an image for the cover, choose a price and in about four hours it'll be for sale on the web.

And in case you think that self-publishing is just for wimps, remember that that's the way Fifty Shades of Grey started.

LESSON 7: Just because governance of the internet is too important to be left to the United Nations doesn't mean that it doesn't need governance

The farce that was the World Conference on International Telecommunications (WCIT-12) has ended, but the problem of internet governance endures. The conference was ostensibly about updating and harmonising international telecommunications protocols (for example, mobile roaming rates) but some countries, including quite a few authoritarian regimes, and phone companies sought to use it as a vehicle for controlling internet content and levying charges on those who create and provide it.

In the end, the conference broke up in thinly veiled disarray, with most western countries refusing to sign up to the proposition that the International Telecommunication Union (ITU) should have any major role in internet governance. Two cheers for that. But we are still left with a problem, which, crudely stated, is this: it ain't broke, but it needs fixing. Because of its history, governance of the net is unduly weighted in favour of US-based or US-dominated institutions. This was fine when the internet was predominantly a US-European phenomenon. But now it's a truly global network and we need a multinational governance structure that a) reflects that reality but b) doesn't break the openness and vitality of the system. The first person to crack that problem gets a Nobel prize.

LESSON 8: If you want privacy keep off the net. Or at least encrypt your stuff

In 1999, Scott McNealy, then the CEO of Sun Microsystems, famously observed that consumer privacy issues were a "red herring". "You have zero privacy anyway," he said. "Get over it."

At the time, people wondered what Scott had been smoking. Now we know better. We have been sleepwalking into a networked world where privacy is ostensibly worshipped like motherhood and apple pie but is everywhere abused.

You may wonder why particular ads seems to follow you everywhere you go on the web? Or why brands you "like" mysteriously turn up in your timeline and in those of your "friends". Google knows every YouTube video you've ever watched (and also what's in your Gmail). Facebook knows all of this stuff plus your real name.

And, on the other side of the fence, the US National Security Agency (and possibly also its overseas franchises) is hoovering up all your electronic communications. The UK Data Communications Bill suggests that our domestic agencies have similar ambitions. And western countries are still selling electronic surveillance kit to repressive regimes all over the world.

The only real solution is to switch off your mobile phone and never again use the net. Failing that, you could try encrypting your email using something such as PGP. But that's not for the faint-hearted, so perhaps the rule to live by is this: don't put anything in an email that you wouldn't put on a postcard.

LESSON 9: The future's mobile and that's not necessarily good news

2012 showed that the explosion in the adoption of smartphones (ie internet-connected mobile handsets) and tablet computers shows no signs of abating. This means that we're heading for a world in which most people will access the internet via handheld devices. And this has major implications. The upsides are clear: it will be easier for billions of people to integrate the net into their daily lives, with all the benefits that that can bring.

The downsides are less obvious to most people, but they are worrying and real. In particular, it will be a world in which most people access the net via closed, "tethered" devices that will greatly enhance the powers of corporations that few of us have any reason to trust. Technology giveth and technology taketh away.

Senate, House agriculture committees in deal to avert milk price spike

WASHINGTON (Reuters) - Farm-state lawmakers have agreed to a one-year extension of the expiring U.S. farm law that, if enacted, would head off a possible doubling of retail milk prices to $7 or more a gallon in early 2013.

The extension would end a 32-month attempt to update farm subsidies dating from the Depression era, when farmers were crushed by low prices and huge crop surpluses, to meet today's high-wire challenges of tight food supplies, high operating costs and volatile markets.

House Agriculture Committee Chairman Frank Lucas, an Oklahoma Republican, said on Sunday he hoped the legislation would be passed by Congress and signed by President Barack Obama by Tuesday to avoid higher prices for milk in grocery stores.

The bill was listed among measures that could be called for a vote on Monday in the House of Representatives although action was not guaranteed.

Despite consensus on the need to extend the farm bill, lawmakers continue to discuss how long the extension should be.

Representative Tom Cole, an Oklahoma Republican, told reporters late on Sunday a nine-month farm bill extension was being considered as part of deal being crafted in the Senate to stave off the "fiscal cliff" of automatic tax hikes and spending cuts that begin kicking in on January 1.

"There's good chance that if there is a package out of the Senate, it will include something on the farm bill. The easiest thing to get done would be nine months of current law," Cole said.

A second Republican, Representative Steven LaTourette, said a nine-month extension could be part of the fiscal cliff package or could move separately if the fiscal talks fail.

House Republican leaders refused to call a vote during the fall on a full-scale, $500 billion farm bill on grounds it might fail because it did not cut spending enough.

Grain, soybean and cotton growers would get another round of the $5 billion "direct payment" subsidy that all sides agreed to kill in a new farm bill. The payments are made regardless of need. Reformers say the payments are unjustified when crop prices and farm income are at near-record levels.

DISASTER MONEY AND A NEW DAIRY PROGRAM

Also in the extension, lawmakers would revive agricultural disaster-relief programs that ran out of money a year ago and create a new dairy subsidy program. It would compensate dairy farmers whenever milk prices are low and feed prices are high. The so-called margin protection program would require farmers to limit production to avert a long run of low dairy prices.

Traditionally, the dairy program sets a minimum price for milk through government purchase of butter, cheese and dry milk. If Congress does not act, the dairy support price will revert on Tuesday to the level dictated by an outmoded 1949 law and which is roughly double the price now paid to farmers.

The potential retail milk price has been estimated at $6 to $8 a gallon versus current levels near $3.50.

Agriculture Secretary Tom Vilsack, during an interview broadcast by CNN, said higher milk prices - if it comes to that - would ripple throughout all commodities "if this thing goes on for an extended period of time."

Senator Debbie Stabenow, chairwoman of the Senate Agriculture Committee, said the "responsible short-term farm bill extension ... not only stops milk prices from spiking, but also prevents eventual damage to our entire agriculture economy."

TWO FALLBACKS IF EXTENSION FALTERS

House Republican leaders readied two alternatives, if needed, to the one-year extension. One was a one-month extension of the now-expired 2008 farm law without disaster funds or the new dairy program and the other was a one-month suspension of the dairy provisions of the 1949 law.

It was not clear which bill would be called for debate, a farm lobbyist said on Sunday. A small-farm activist said any package passed by Congress must include rural economic development funds and money for soil conservation on "working lands," the largest of USDA's conservation programs.

"If a new farm bill doesn't pass this Congress, we'll soon hold another mark-up and just keep working until one is enacted next year," said Stabenow, a Michigan Democrat.

It would be the first time on record that Congress began drafting a farm bill during a two-year session and had to carry it into the following session, congressional researchers said. Hearings on the new farm bill began April 21, 2010.

HOUSE, SENATE DISPUTE ON BIG CUTS

While dairy producers generally support the so-called margin-protection program as the answer to high feed costs, processors and foodmakers oppose it. They say it is wrong-minded in its premise of curtailing production when prices are low, and it will destroy a healthy export market for dairy products.

The rejuvenated disaster programs would cover losses from this year's widespread drought, especially for livestock producers, although tree farmers, honey bees and farm-raised fish are also covered. Maximum payment would be $100,000.

Senators passed a farm bill in June estimated to save $23 billion over 10 years, with most of the cuts in crop subsidies and conservation programs. The House Agriculture Committee approved a bill with $35 billion in cuts in July, half of it in food stamps for the poor - the biggest cut in food stamps in a generation.

Fiscally conservative House Republicans have called for larger cuts in farm subsidies and food stamps while some House Democrats opposed any food stamp cuts.

German magazine mistakenly publishes Bush obituary

BERLIN (AP) ? Germany's respected news weekly Der Spiegel has mistakenly published an obituary for former U.S. President George H.W. Bush.

The unfinished obituary appeared on Der Spiegel's website for only a few minutes Sunday before it was spotted by Internet users and removed.

In it, the magazine's New York correspondent Marc Pitzke describes Bush as "a colorless politician" whose image only improved when it was compared to the later presidency of his son, George W. Bush.

Bush was hospitalized in Houston Nov. 23 for treatment of a bronchitis-related cough. He was moved to intensive care on Dec. 23 after he developed a fever.

A family spokesman says the 88-year-old former president was moved out of intensive care into a regular hospital room again Saturday after his condition improved.

Refinance options for 100% LTV? - Zillow Mortgage Advice

Hi All,

I just recently got denied for a refinance because the appraisal came in considerably lower ($243,000) than what I had expected which put our LTV at 100%.

Do I have any available refinance options available at the moment? Should I begin pay down the principal more rapidly? Is there a specific LTV number that would qualify me for refinance?

Any advice would be appreciated.

Two new orchid species found

One of the world's newest orchid species is also its most delicate, with tiny white flowers smaller than a dime. Yet the flower finds its home amid boulders near the banks of rushing streams in Cuba's remote eastern mountains.

The orchid is one of two new species identified by botanists in Cuba, a hotbed for orchids ? the largest and most diverse plant family in the world. The islands of the Caribbean have more the 25,000 species of orchids tucked into their forests and rivers.

The new species was named Tetramicra riparia, a nod to its discovery along stony streams in the mountains of Baracoa, one of the rainiest and least explored areas in Cuba, ?ngel Vale, a researcher at the University of Vigo in Spain, said in a statement. The plant has an unusually broad, sturdy base: Its pedicel is almost four times as large as its column, Vale and his co-authors report.

The second new orchid, from the western tip of the island, dwarfs its neighbor in size. The flower's showy purple and green petals are similar to a daffodil in appearance, spreading more than 2.5 inches, with up to 20 blooms on one plant.

Like many orchids, the flower, dubbed Encyclia navarroi, is epiphytic, meaning it grows on other plants for support, but not for nutrients. Along the western coast, the species preferred to perch on plumeria and ficus, the researchers discovered.

Both new species are deceit pollinators, Vale said, enticing bees to spread their pollen without a reward. "Contrary to most plants, many orchids do not produce nectar or other substances to compensate insects and birds that visit them," he said.

Vale and his colleagues are studying orchids throughout the Greater Antilles (Cuba, Jamaica, Hispaniola, Puerto Rico) to reconstruct their evolutionary history and analyze the effect of pollinators in their development. One of the mysteries they aim to solve is whether deceit orchids have greater diversity than other nectar-producing species.

"Despite the fact that T. riparia's flowers have a complete central petal, just like other species that make up a subgenre endemic to Cuba; the way they grow is very similar to a more widespread group that seems to have diverged on the neighboring island of Hispaniola," Vale said. "Our work provides molecular evidence of the greater relationship of T. riparia with these species on the neighboring island."

The findings were detailed in the October 2012 issue of the journal Systematic Botany and the April 2012 issue of the journal Annales Botanici Fennici.

Huawei has already confirmed that we're going to see its extra-large Ascend D2 at CES, but that doesn't mean a sneak peek is unwelcome. ITHome is more than willing to sate our curiosity with a set of photos that purportedly show a fully functional version of the 5-inch smartphone. In a sense, we know what to expect from the software: the D2 appears to be using the same customized Android layer as the even larger Ascend Mate, just without that fifth column of icons. The shots do, however, suggest that Huawei is going for a design as premium-looking on the outside as it is high-powered on the inside. Not much else is known, but we'll likely understand Huawei's fuller ambitions in Las Vegas next month.

THURSDAY, Dec. 27 (HealthDay News) ? Taking a pill called naltrexone (ReVia) when they stop smoking could help women keep dreaded weight gain at bay, according to new research.

Researchers analyzed two earlier studies that compared the quit rates and weight gain among heavy smokers who received either naltrexone ? a drug used to treat addiction ? or an inactive placebo, along with a nicotine patch and weekly counseling while trying to quit smoking.

Although the groups taking naltrexone had higher quit rates at the end of four- and six-week treatment courses, participants who took the drug were no more likely to remain abstinent after 12 months.

But women who took naltrexone gained significantly less weight six and 12 months after they quit smoking than women who received the placebo, according to the study, published in the December issue of Biological Psychiatry. However, this difference was not observed for men.

?Weight gain is a crucial issue for people, especially women who have societal pressure and can be more discontented with their bodies,? said Andrea King, a professor of psychiatry and behavioral neuroscience at the University of Chicago and lead author of the current study.

?Even if naltrexone doesn?t help quit rates, if we could break down that barrier, it could have an impact,? King added.

More than 80 percent of people who quit smoking gain weight, and the average weight gain is between five and 10 pounds, according to the study. However, as many as one-quarter of quitters gain more than 15 pounds.

Weight gain during smoking cessation is usually modest and not a serious health problem compared to the health benefit of quitting smoking, said Dr. Norman Edelman, chief medical officer of the American Lung Association.

?[But] people, especially young women, would be more likely to get involved in smoking cessation programs if there were some way to control their weight gain so in terms of that, I think [naltrexone] is important,? Edelman said.

People who want to quit smoking and are worried about gaining weight should talk with their doctor about naltrexone, he suggested.

Both issues can be deadly. Tobacco is the leading cause of preventable deaths in the United States, and obesity is second, the study authors noted.

King pointed out that naltrexone would probably not take the place of the first-line treatments for quitting smoking, which are the antidepressant bupropion (Zyban), in some cases together with a nicotine patch such as Nicoderm or the drug varenicline (Chantix).

However, naltrexone, along with a nicotine patch and counseling, could be an option for those who did not have success with these treatments or who have serious concerns about weight gain, King said.

The side effects associated with naltrexone are generally mild and rare, King said. Nausea, dizziness and fatigue are most common, and often overcome by taking the once-a-day medication with food or at bedtime, she added.

For the current study, King and her colleagues analyzed the results of studies done at the University of Chicago and Yale University in New Haven, Conn.

The Chicago study involved more than 300 adults who smoked between 10 and 40 cigarettes a day for at least the past two years. During the four-week treatment, participants took either naltrexone or the placebo, used Nicoderm and received behavioral and cognitive counseling.

The Yale study had nearly 400 adults who smoked 20 or more cigarettes a day for at least the past year. It was similar to the Chicago study, except the researchers tested a six-week treatment course and three doses of naltrexone along with placebo.

Women who took naltrexone gained an average of about 7.3 pounds and 13 pounds six and 12 months after treatment, respectively, whereas the women who received placebo gained an average of about 12.1 and 16.3 pounds, respectively, the researchers found.

In addition, a slightly smaller proportion of women taking naltrexone increased their body weight by 7 percent or more, which the U.S. Food and Drug Administration (FDA) considers clinically significant weight gain.

The men in the study gained less weight on average than women, and these gains were a smaller percentage of their original body weight, which could have made it more difficult to detect lower weight gain among men taking naltrexone, King said. More research is needed on this group, she added.

It is not clear why women seem to be more prone to weight gain when they quit smoking than men.

?I think of women smoking more for emotional regulation and management, and potentially without that crutch, they may turn to high sweet and fat foods more than men,? King said.

Naltrexone is thought to block the effects of opioids in the body, which could reduce cravings for sweet and fatty foods, King noted.

In addition, giving up cigarettes leads to drops in metabolism that can cause quitters to put on pounds no matter what they eat, King pointed out.

King encourages people trying to quit to eat sensibly and exercise, which can help reduce the stress of quitting, but not to diet, which can make quitting even more difficult.

?If there are times when you?re going to have a candy bar or a cigarette, a candy bar is better, and don?t beat yourself up about it,? King said.

Naltrexone is not approved by the FDA for smoking cessation and is instead used off-label for this indication. It is approved to help people overcome alcohol and drug addictions.

Klein and Seydoux give such naturalistic performances that they're never overwhelmed by the spectacle.

"Sister" is loose and episodic, but held together with nicely sketched characters.

[A]voids bathos. . .reveals unexpected depth in a heartbreaking bond. . . Different classes conflict [in] adjacent spaces . . .in spare, realistic Dardennes' style.

Meier draws out wonderfully naturalistic performances from her young stars, with Mottet Klein particularly good as the young roustabout Simon ...

It comes over like a subtle short story and is well acted.

Meier's portrait of Simon ... is richly atmospheric and never sentimental.

An enigmatic, heartfelt account of a vulnerable young boy's yearning for a better life.

Most intriguing is how the writers and director have transformed what's essentially a rather dark, bleak story into something involving and emotionally resonant, all without ever turning sentimental.

It is an interesting and well-made movie, though with an uncertain ending.

Sister gradually reveals pattern in its tapestry of everyday life.

An expert piece of storytelling with a host of strong character turns and thematic depth to burn.

Quarterback-of-all-trades Tim Tebow has addressed with the media the report that he asked to be omitted from the team?s Wildcat package after being informed that he wouldn?t be the starting quarterback in Week 16.

?I never said, ?Hey, I don?t want to do anything.? I won?t do anything,?? Tebow said Wednesday, via Manish Mehta of the New York Daily News.? ?That wasn?t the talk at all.? He knows that.? And everybody on this team knows that I would never not to do something if I was asked.? That?s what?s disappointing.? People saying, ?Oh, you quit.? Or you didn?t do this.?? That was not it at all.? It was just me asking to get an opportunity to play the position I love, which is quarterback.? It wasn?t me asking out of anything.?

Tebow acknowledges that coach Rex Ryan may have misinterpreted the message, and Tebow says he wishes he would have been ?more clear? when meeting with Ryan.

?You work your whole life to build a reputation,? Tebow said.

That line, of course, will do nothing to convince those who think that Tebow is concerned more about his image than anything else.? Indeed, it will make the skeptics even more suspicious that there?s a disconnect between Tebow and his ?reputation.?

For that reason, it would make more sense for Tebow to admit that, yes, he?s human.? And, yes, he sometimes has bad days.? And, yes, he was frustrated last week.? And, yes, he made it known that if he?s not the starter he doesn?t want to be the gimmick, either.

Saying that would go a much longer way toward helping his ?reputation? than the clumsy manner in which he has handled the current situation.

Police bring crime victim new cell phone | woman, police, beach ...

LAGUNA BEACH ? Police officials are bringing some Christmas spirit to a recent robbery victim on Tuesday, providing her with a new phone to replace one stolen during an attack.

The Laguna Beach Police Employee Association teamed up with the non-profit Crime Survivors organization and Boost Mobile to support the local hairstylist after she was violently attacked while leaving work on Dec. 8.

The woman, who authorities are not identifying because she was a crime victim, was walking from a Laguna Beach salon to her car when she was confronted by two men in a parking garage. The men pointed what turned out to be airsoft guns ? replica firearms that shoot plastic pellets -- at her, and demanded her wallet, said Larry Bammer, president of the Laguna Beach Police Association.

As the woman attempted to keep walking to her car, the men approached her, pressed one of the airsoft guns into her back and fired. The woman fought back as the men grabbed her purse, kicking and screaming before the robbers got her purse and ran away, Bammer said.

The robbers escaped with $100 in cash from the purse, which the woman needed for a month's worth of groceries, as well as a new cell phone, Bammer said. The woman also sustained a serious bruise and welt in the center of her back, where she had been shot by the airsoft gun.

Two of the officers who responded the night of the robbery paid the woman back the stolen $100 from their own pockets. Crime Survivors reached out to support the woman, while Boost Mobile agreed to donate a new HTC cell phone after hearing of the robbery.

Police say the two robbers, as well as a suspected getaway driver, were later arrested in Westminster. Their names were not immediately available.

Details From News Corp's Latest Ad Hacking ... - Business Insider

Although News Corp's latest hacking scandal doesn't involve breaking into the voicemails of deceased school girls or 9/11 victims' relatives, it does illuminate how the corporation allegedly used hacking to gain a marketing edge in 40,000 retail stores in the United States.

Courhouse News Service reports that Dial Soaps sued News Corporation, News America, News America Marketing FSI, and News America Marketing In-Store Service, alleging News Corp. gained an unfair monopoly over?in-store promotions in tens of thousands of retail stores and free-standing newspaper inserts.

This monopoly was allegedly done by hacking "customer lists and other marketing materials to solicit its accounts and lock them into News long-term and exclusive contracts."

The suit, excerpted from Courthouse News Service, begins:

"In two distinct relevant markets the multifaceted and pervasive exclusionary strategies of defendants ('News') over twenty years have violated the antitrust laws of the United States. News has suppressed competitive promotion of a massive number of consumer goods in forty thousand retail stores, and scores of newspapers nationwide, to acquire and maintain two unlawful monopolies and earn large monopoly profits at the expense of its purchasers."

A particularly colorful detail in the lawsuit depicts a board meeting in which top execs allegedly used Al Capone's ethically questionable sales tactics as a model. (Emphasis is ours):

Its unlawful purposes could not be more transparent. For example, in a sales meeting Paul Carlucci, then News America Inc.'s Chief Operating Officer, Paul Carlucci, illustrated News' desire for the ultimate in competitive suppression with a video from 'The Untouchables,' in which Al Capone serves as a sales role model as he cudgels a competitive enemy to death with a baseball bat. Mr. Carlucci has been equally blunt with the press as to News' exclusionary purposes, vowing to 'destroy' his competitors as a 'man who has to have it all.'

Mr. Carlucci threatened to fire any News employee ('concerned about doing the right thing') who did not support exclusive control by News of shelves in retail accounts.?

The lawsuit also accuses News Corp. of:

Using large cash guarantees unjustified by potential in-store promotional revenues to derail competitor contracts with retailers, a practice expressly designed to exclude competitors from these chains; ...?

Defacing competitors' in-store advertisements and then disparaging the quality of the defaced promotions to the retail chains.

Dial's lawsuit also cited News Corp's past cases of breaking competitors in "floor advertising (the late Floorgraphics' Floortalk) or shelf signs with brand price messaging (Insignia's POPSign)."

In 2009, before the British hacking scandal came to light, Floorgraphics alleged News America?"illegally accessed plaintiff?s computer system and obtained proprietary information? and ?disseminated false, misleading and malicious information about the plaintiff.? The case settled for $29.5 million.

Over the fiscal cliff: Soft landing or dizzy dive?

WASHINGTON (AP) -- Efforts to save the nation from going over a year-end "fiscal cliff" were in disarray as lawmakers fled the Capitol for their Christmas break. "God only knows" how a deal can be reached now, House Speaker John Boehner declared.

President Barack Obama, on his way out of town himself, insisted a bargain could still be struck before Dec. 31. "Call me a hopeless optimist," he said.

A look at why it's so hard for Republicans and Democrats to compromise on urgent matters of taxes and spending, and what happens if they fail to meet their deadline:

___

NEW YEAR'S HEADACHE

Partly by fate, partly by design, some scary fiscal forces come together at the start of 2013 unless Congress and Obama act to stop them. They include:

? Some $536 billion in tax increases, touching nearly all Americans, because various federal tax cuts and breaks expire at year's end.

? About $110 billion in spending cuts divided equally between the military and most other federal departments. That's about 8 percent of their annual budgets, 9 percent for the Pentagon.

Hitting the national economy with that double whammy of tax increases and spending cuts is what's called going over the "fiscal cliff." If allowed to unfold over 2013, it would lead to recession, a big jump in unemployment and financial market turmoil, economists predict.

WHAT IF THEY MISS THE DEADLINE?

If New Year's Day arrives without a deal, the nation shouldn't plunge onto the shoals of recession immediately. There still might be time to engineer a soft landing.

So long as lawmakers and the president appear to be working toward agreement, the tax hikes and spending cuts could mostly be held at bay for a few weeks. Then they could be retroactively repealed once a deal was reached.

The big wild card is the stock market and the nation's financial confidence: Would traders start to panic if Washington appeared unable to reach accord? Would worried consumers and businesses sharply reduce their spending? In what could be a preview, stock prices around the world dropped Friday after House Republican leaders' plan for addressing the fiscal cliff collapsed.

Federal Reserve Chairman Ben Bernanke has warned lawmakers that the economy is already suffering from the uncertainty and they shouldn't risk making it worse by blowing past their deadline.

WHAT IF THEY NEVER AGREE?

If negotiations between Obama and Congress collapse completely, 2013 looks like a rocky year.

Taxes would jump $2,400 on average for families with incomes of $50,000 to $75,000, according to a study by the non-partisan Tax Policy Center. Because consumers would get less of their paychecks to spend, businesses and jobs would suffer.

At the same time, Americans would feel cuts in government services; some federal workers would be furloughed or laid off, and companies would lose government business. The nation would lose up to 3.4 million jobs, the Congressional Budget Office predicts.

"The consequences of that would be felt by everybody," Bernanke says.

THE TAXES

Much of the disagreement surrounds the George W. Bush-era income tax cuts, and whether those rates should be allowed to rise for the nation's wealthiest taxpayers. Both political parties say they want to protect the middle-class from tax increases.

Several tax breaks begun in 2009 to stimulate the economy by aiding low- and middle-income families are also set to expire Jan. 1. The alternative minimum tax would expand to catch 28 million more taxpayers, with an average increase of $3,700 a year. Taxes on investments would rise, too. More deaths would be covered by the federal estate tax, and the rate climbs from 35 percent to 55 percent. Some corporate tax breaks would end.

The temporary Social Security payroll tax cut also is due to expire. That tax break for most Americans seems likely to end even if a fiscal cliff deal is reached, now that Obama has backed down from his call to prolong it as an economic stimulus.

THE SPENDING

If the nation goes over the fiscal cliff, budget cuts of 8 or 9 percent would hit most of the federal government, touching all sorts of things from agriculture to law enforcement and the military to weather forecasting. A few areas, such as Social Security benefits, Veterans Affairs and some programs for the poor, are exempt.

THERE'S MORE AT STAKE

All sorts of stuff could get wrapped up in the fiscal cliff deal-making. A sampling:

? Some 2 million jobless Americans may lose their federal unemployment aid. Obama wants to continue the benefits extension as part of the deal; Republicans say it's too costly.

? Social Security recipients might see their checks grow more slowly. As part of a possible deal, Obama and Republican leaders want to change the way cost-of-living adjustments are calculated, which would mean smaller checks over the years for retirees who get Social Security, veterans' benefits or government pensions.

? The price of milk could double. If Congress doesn't provide a fix for expiring dairy price supports before Jan. 1, milk-drinking families could feel the pinch. One scenario is to attach a farm bill extension to the fiscal cliff legislation ? if a compromise is reached in time.

? Millions of taxpayers who want to file their 2012 returns before mid-March will be held up while they wait to see if Congress comes through with a deal to stop the alternative minimum tax from hitting more people.

CALL THE WHOLE THING OFF?

In theory, Congress and Obama could just say no to the fiscal cliff, by extending all the tax cuts and overturning the automatic spending reductions in current law. But both Republicans and Democrats agree it's time to take steps to put the nation on a path away from a future of crippling debt.

Indeed, the automatic spending cuts set for January were created as a last-ditch effort to force Congress to deal with the debt problem.

If Washington bypassed the fiscal cliff, the next crisis would be just around the corner, in late February or early March, when the government reaches a $16.4 trillion ceiling on the amount of money it can borrow.

Boehner says Republicans won't go along with raising the limit on government borrowing unless the increase is matched by spending cuts to help attack the long-term debt problem. Failing to raise the debt ceiling could lead to a first-ever U.S. default that would roil the financial markets and shake worldwide confidence in the United States.

To avoid that scenario, Obama and Boehner are trying to wrap a debt limit agreement into the fiscal cliff negotiations.

SO WHAT'S THE HOLDUP?

They're at loggerheads over some big questions.

Obama says any deal must include higher taxes for the wealthiest Americans. Many House Republicans oppose raising anyone's tax rates. Boehner tried to get the House to vote for higher taxes only on incomes above $1 million but dropped the effort when it became clear he didn't have the votes.

Republicans also insist on deeper spending cuts than Democrats want to make. And they want to bring the nation's long-term debt under control by significantly curtailing the growth of Medicare, Medicaid and Social Security ? changes that many Democrats oppose.

Obama, meanwhile, wants more temporary economic "stimulus" spending to help speed up a sluggish recovery. Republicans say the nation can't afford it.

IT'S NOT JUST WASHINGTON

Seems like they could just make nice, shake hands and split their differences, right?

But there's a reason neither side wants to give ground. The two parties represent a divided and inconsistent America. True, Obama just won re-election. But voters also chose a Republican majority in the House.

Republican and Democrats alike say they are doing what the voters back home want.

Neither side has a clear advantage in public opinion. In an Associated Press-GfK poll, 43 percent said they trust the Democrats more to manage the federal budget deficit and 40 percent preferred the Republicans. There's a similar split on who's more trusted with taxes.

About half of Americans support higher taxes for the wealthy, the poll says, and about 10 percent want tax increases all around. Still, almost half say cutting government services, not raising taxes, should be the main focus of lawmakers as they try to balance the budget.

When asked about specific budget cuts being discussed in Washington, few Americans express support for them.

THE COUNTDOWN

Time for deal-making is short, thanks to the holiday and congressional calendars. Some key dates for averting the fiscal cliff:

? Lawmakers aren't expected to return to the Capitol until after Christmas, leaving less than a week to vote on a compromise before year's end.

? Obama and his family also were leaving town for a Christmas vacation in Hawaii. The president said because the fiscal cliff was still unresolved, he would return to Washington next week.

? If lawmakers reach Dec. 31 without a deal, some economists worry that the financial markets might swoon.

? The current Congress is in session only through noon Eastern time on Jan. 3. After that, a newly elected Congress with 13 new senators and 82 new House members would inherit the problem.
